2011 CLARK HOWARD’S FREE GAS CONTEST RULES

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN.  ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.   MUST BE 21 YEARS OF AGE AND A LEGAL RESIDENT OF GEORGIA TO PARTICIPATE.

1.           SPONSORS:  The FREE GAS Contest (“the Contest”) is sponsored by Cox Media Group, Inc., d/b/a AM 750 and NOW 95.5FM News/Talk WSB or News/Talk WSB (“Sponsor”), whose decisions regarding winner selection and all other aspects of the Contest shall be final and binding in all respects.

2.             CONTEST PERIOD:  The Contest will begin Thursday, June 2, 2011 and will conclude on Friday, June 17, 2011.

3.             ELIGIBILITY:  The Contest is only open to legal residents of Georgia who are 21 years of age or older at time of entry.  Contest void where prohibited by law.  Employees of Cox Enterprises, Inc., Cox Media Group, Inc., News/Talk WSB, other radio stations, promotional sponsors and all affiliated companies (and the immediate family members of all such employees, and all others with whom they are domiciled) are not eligible to participate in the Contest or win prizes. The term “immediate family members” includes spouses, grandparents, siblings, children, and grandchildren.

4.             HOW TO ENTER:  Enter the contest by clicking on the CLARK’S HOWARD’S FREE GAS CONTEST banner on wsbradio.com or the contest page at wsbradio.com or by sending a 3x5 post card including your name, age, daytime phone number, zip code and email address to: “Clark Howard’s Free Gas Contest”, c/o News/Talk WSB, 1601 West Peachtree Street, Atlanta, Ga. 30309.  One entry per person.  Deadline for receipt of entries is 2:00pm on Friday, June 17, 2011 in order to be eligible for at least one drawing.

Sponsors are not responsible for incomplete, lost, late, illegible, or mutilated entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsors.  Listeners accessing our station audio via IP (eye-pee) connections like website-based streaming or mobile devices are welcome to enter.  However, News/Talk WSB cannot be responsible for delays in electronic transmission of station audio to IP devices.  By entering this contest, listeners acknowledge their understanding and agreement to this specific provision of the contest rules.

5.             PRIZES:  Up to twenty-six (26) winners of $100 in FREE Kroger gas.  Prize will be paid in the form of a Kroger Fuel Center gas card of $100.

                GRAND PRIZE: Up to four (4) Grand Prize winners of $1000 in FREE Kroger gas. Prize will be paid in the form of a Kroger Fuel Center gas card of $1000. Grand prize names will be called at 8:20am on Monday, June 6, Friday, June 10, Monday, June 13 and Friday, June 17.

                  By accepting a prize, each winner acknowledges and agrees that the prices of products and services offered as prizes often fluctuate.  Winners further agree that the value stated in these Official Rules for the prize or prizes offered reflects the good faith estimate of the Sponsor, which shall be final and binding for all purposes relating to the Contest, including the reporting of prize values to the Internal Revenue Service.

6.             WINNER NOTIFICATION AND ACCEPTANCE: There is a possibility of up to thirty (30) winners selected in thirty (30) random drawings.  All thirty drawings will be done under the supervision of News/Talk WSB.  Potential winner’s names will be selected at random at 2 pm the weekday before it is announced.  Each weekday, June 6-17, 2011 one potential winner’s name will be announced on-air at 8:20am, 12:20pm and another potential winner’s name will be announced on-air at 3:20pm.

After each name is announced the potential winner has 30 minutes to call 404-741-0750 to claim their prize.  If the potential winner does not call back within 30 minutes the prize remains in possession of News/Talk WSB.

All winners will be required to claim their prizes at the offices of News/Talk WSB, 1601 W. Peachtree St., NE, Atlanta, Georgia 30309, during regular business hours Monday-Friday before.  Each winner must provide Sponsors with a valid State of Georgia issued photo ID.  Each Winner is solely responsible for the reporting and payment of any taxes on prizes.  Failure to do any of the foregoing in a timely manner may, at Sponsor’s option, result in forfeiture of prize. Each winner may waive his or her right to receive the prize.  No substitutions allowed, except that prize and individual components of the prize package are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value.  Prizes are non-assignable and non-transferable.  Contest void where prohibited by law. As a condition of receiving any contest prize, each winner will be required to complete an affidavit of eligibility and a liability and publicity release, which must be signed at the time the winner claims his/her prize at the News/Talk WSB Business Office.  Failure to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner’s disqualification and the forfeiture of his or her interest in the prize.  Except where prohibited, participation in the Contest constitutes each winner’s consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from News/Talk WSB, and Cox Media Group, and on the Cox Media Group Interactive Web sites, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation.  Winners’ names may be obtained by sending a request with self-addressed, stamped envelope to News/Talk WSB 1601 W. Peachtree St., NE, Atlanta, GA  30309.

7.             PARTICIPATION:  Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules.  Sponsor reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest.

8.             LIMITATIONS OF LIABILITY: By entering the Contest, contestants agree that:  (1) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all rights to claim punitive, incidental or consequential damages and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

9.             CONSTRUCTION:   All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Georgia.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

10.          GENERAL RELEASE: By entering the Contest, contestants release Sponsor, any other promotional sponsors and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).

11.          PROMOTIONAL RELEASE:  By submitting an entry, each contestant grants to Sponsor the right to use his or her submission in any manner or media all without further compensation.  Each contestant further grants to Sponsor and its affiliates and advertising, promotion and production agencies, and their respective assigns, the absolute right and permission to use his or her name, address, photograph and/or likeness in any and all advertising and promotional materials, in any manner or media whatsoever, for purposes of advertising, trade or promotion. Each contestant acknowledges and agrees that he or she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, or distortion of his or her name, submission, address, photograph or likeness.

Privacy: Information collected from contestant is used only for the purpose of the prize drawing and to notify potential winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless entrant has opted-in to receive additional information and promotional material from Sponsor or a third party.
