Cabot Community Celebrity Cruise

 

OFFICIAL RULES

 

NO PURCHASE NECESSARY.  A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.  ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

 

  1. 1.Sponsor.The Cabot Community Celebrity Cruise promotion (the “Promotion”) is sponsored by Cox Radio, Inc. d/b/a WSB-AM/WSBB-FM (“Sponsor”), whose decisions regarding the selection of the recipient of the Cabot Community Celebrity Award, and all other aspects of the Promotion, shall be final and binding in all respects.

     

  2. Promotional Period.The Promotion will begin at 6:00 a.m. (E.T.) on Wednesday, September 25, 2013 and end at 11:59 p.m. (E.T.) on Sunday, October 20, 2013 (the “Promotional Period”).Sponsor will be the official timekeeper for the Promotion.

 

3.         Eligibility.  Subject to the additional restrictions below, nominations for the 2013 Cabot Community Celebrity Award must be submitted by legal residents of the state of Georgia who are 18 years or older with a valid Georgia Driver’s License or Georgia State Issued ID (or other proof of Georgia residency, such as a copy of a utility bill) at the time of submission.  Employees of Sponsor, and each of its affiliated companies, subsidiaries, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to participate or receive an award in the Promotion.  The term “immediate family members” includes spouses, parents, grandparents, siblings, children, grandchildren and in-laws, regardless of where they live.

 

  1. How To Make Your Nomination.

 

To nominate a potential candidate for the 2013 Cabot Community Celebrity Award, visit the Cabot Community Celebrity Cruise official registration page on www.wsbradio.com and complete all of the required information and follow all posted instructions.  To be eligible for the award, a nominee must be a legal resident of the continental United States and demonstrate a commitment to service in the community.  Examples include, but are not limited to, volunteering at a food bank, reading to children in a school, or delivering meals to the elderly.  In some cases, a nominee may also be a paid employee within an organization who goes above and beyond the expectations of his/her role.  Your nominee must also be 21 years or older.

 

As part of the nomination process, you must upload your original essay of 250 words or less describing why your nominee is particularly deserving of receiving the Cabot Community Celebrity Award.  Nomination entries that are in compliance with these Official Rules may be posted to the Sponsor’s website as they are received, reviewed, and verified by Sponsor.

 

PARTICIPANTS ARE NOT PERMITTED TO NOMINATE THEMSELVES.

 

BY PARTICIPATING IN THE PROMOTION, YOU ACKNOWLEDGE AND AGREE THAT YOUR NOMINATION IS TRUTHFUL AND ACCURATE, AND REFLECTS YOUR HONEST OPINIONS AND BELIEFS ABOUT WHY YOUR NOMINEE SHOULD BE NAMED THE CABOT COMMUNITY CELEBRITY.  YOU ALSO REPRESENT AND WARRANT THAT YOU ARE NOMINATING ANOTHER PERSON AND NOT YOURSELF AND YOU HAVE OBTAINED PERMISSION TO SUBMIT YOUR NOMINATION FROM THE PERSON NAMED AND DESCRIBED IN YOUR ENTRY, AND YOU CAN MAKE THAT AUTHORIZATION AVAILABLE TO SPONSOR UPON REQUEST.  UPON SUBMITTING YOUR NOMINATION, YOU ACKNOWLEDGE AND AGREE THAT YOU WILL NOT RECEIVE THE AWARD IF THE PERSON YOU NOMINATE IS SELECTED BY THE PANEL OF JUDGES DESIGNATED BY SPONSOR.  YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOU WILL BE RESPONSIBLE FOR CONTACTING THE PERSON YOU NOMINATE IF HE OR SHE IS SELECTED AS THE AWARD RECIPIENT.

 

Maximum one (1) nomination entry per person and per email address during the Promotional Period.

 

The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of nomination entries will void that participant’s nomination entries and may result in participant or his/her nominee’s disqualification.  Incomplete, forged, altered, automated, mechanically-reproduced, lost, late, misdirected, garbled or illegible nomination entries will be disqualified.  Sponsor will not be responsible for failure to receive nomination entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Sponsor, or Sponsor’s promotional application service provider.  In the event of a dispute, all online nomination entries will be deemed to have been submitted by the owner of the ISP account from which they were sent, provided that such person satisfies all other Promotion eligibility requirements.  For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account.

 

All nomination entries become property of Sponsor and none will be returned.  Any questions regarding the number of nomination entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any nomination entries by persons who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Promotion. 

 

By participating in the Promotion, you agree to be bound by Sponsor’s Visitor Agreement (http://www.wsbradio.com/visitor_agreement/) and Privacy Policy (http://www.wsbradio.com/privacy_policy/), which are hereby incorporated by reference.

 

5.         Entry Restrictions.  The person nominated by the entrant must (i) be 21 years of age or older, and (ii) be a legal resident of the continental United States.  In addition, your entry essay (1) must be suitable for a general audience; (2) cannot contain any sexually explicit, disparaging, libelous or other inappropriate content (all as determined in the sole discretion of Sponsor); (3) cannot contain any trademarks, copyrighted works or other intellectual property (other than works and intellectual property that you own, or for which you have obtained royalty-free rights for Sponsor to use in connection with this Promotion (collectively, “Authorized Assets”).  Any elements appearing in your entry must be entirely original, created by you, be in the public domain, or be an Authorized Asset.  Use of any materials that are not original to you, not in the public domain, or that are not an Authorized Asset may result in disqualification.  Sponsor reserves the right to disqualify any entry that violates the foregoing restrictions, as determined by Sponsor in its sole discretion.

 

6.         Winner Selection.

 

At the end of the Promotional Period, one (1) nominee from the nomination entries will be selected as the potential Cabot Community Celebrity by a committee of judges designated by Sponsor based on the following criteria:  (1) the nature and impact of the nominee’s community service (60%); (2) the emotional appeal of the essay (20%); and (3) the persuasiveness of the essay (20%).  The nominee in the nomination entry with the highest cumulative score will be designated as the potential Cabot Community Celebrity.

 

Sponsor reserves the right to disqualify any potential Cabot Community Celebrity awardee that it determines, in its sole discretion, is not honestly and accurately described in the winning essay entry.

 

7.         Award Description.

 

One (1) Cabot Community Celebrity Award:

 

Subject to verification of eligibility and compliance with these Official Rules, one (1) winning nominee will receive a seven (7) night Southern Caribbean Cruise for two (2) people aboard the Celebrity Summit which departs from the port of San Juan, Puerto Rico on Saturday, January 11, 2014.

 

The award also includes:

 

  • Roundtrip air transportation for two (2) people from the major airport in the Continental United States nearest award recipient’s home (as determined by Sponsor in its sole discretion) to San Juan, Puerto Rico
  • Double occupancy hotel accommodations for one (1) night (one (1) standard room only) in San Juan, Puerto Rico at a hotel chosen by Sponsor in its sole discretion (check-in Friday, January 10, 2014 / check-out Saturday, January 11, 2014 before ship sails)
  • One (1) Category 2-A Veranda Stateroom with balcony aboard the Celebrity Summit (maximum occupancy of two (2) people)
  • All meals aboard ship
  • All port taxes and government fees
  • All shipboard gratuities

 

If award recipient cannot travel during the specified travel dates, then he or she forfeits the entire award.

 

Costs of shore excursions, laundry service, alcoholic beverages, gambling, recreation, local and           long distance telephone calls, ship to shore communications including Internet, merchandise and          souvenirs, other incidentals, additional tips and gratuities, service charges or taxes, and all other   expenses and items not otherwise described above as part of award are the sole responsibility of     award recipient.

 

The award has an approximate retail value of $3,880.00, which may vary depending on the costs of air transportation to and from San Juan, Puerto Rico, and travel itinerary.  If the actual cost is below the estimated retail value of the award, recipient will not receive the difference.

 

A nominee may waive the right to receive an award.  The award is non-assignable and nontransferable and cannot be redeemed for cash.  No substitutions allowed by award recipient.  Award and individual components of the award are subject to availability.  Sponsor reserves the right to substitute award or components of award with an award or component of equal or greater value.  Awards not accepted and claimed by eligible nominees in accordance with these Official Rules will remain the property of Sponsor.

 

A NOMINEE IS NOT A RECIPIENT OF ANY AWARD UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF NOMINEE’S ELIGIBILITY.

 

Limit:  One (1) award per person and per household for the Promotion.  In addition, only one (1) award per person and per household every thirty (30) days for any promotion sponsored by any of the CMG-Atlanta radio stations (i.e., WSB-AM, WSB-FM, WSBB, WALR and WSRV).

 

8.         Notification.   

 

            Sponsor will notify the entrant that submitted the winning nominee (“Selected Entrant”) on or about October 23, 2013 at the telephone number and/or email address provided on the Selected Entrant’s entry form.  The individual nominated by the Selected Entrant will be declared the potential Cabot Community Celebrity (subject to verification of eligibility and compliance with these Official Rules) and the Selected Entrant will be asked to provide the full contact information for his/her nominee.  If the Selected Entrant is unable or unwilling to provide the full contact information for the individual he/she nominated to receive the award, the Selected Entrant and his/her nominee may, in Sponsor’s sole discretion, be disqualified.

 

9.         Acceptance.

 

To accept the award, the potential award recipient must contact Sponsor within seventy-two (72) hours from the time the person who nominated him or her was notified.  Sponsor’s inability to reach a potential award recipient after a reasonable (as solely determined by Sponsor) effort has been made, the failure of a potential award recipient to timely respond to notification, the return of any notification as undeliverable, and/or a potential award recipient’s failure to comply with any term or condition of these Official Rules may, in Sponsor’s sole discretion, result in the potential award recipient’s disqualification and the selection of a runner-up nominee based upon the entry that received the next highest score according to the judging criteria.

 

Upon responding to Sponsor’s notification and accepting the award, recipient must personally visit Sponsor’s offices at 1601 West Peachtree Street NE in Atlanta, Georgia 30309 within fourteen (14) business days after notification.  Office visits must be between the hours of 9:00 a.m. (E.T.) and 5:00 p.m. (E.T.) weekdays.  If award recipient lives out of the state of Georgia or Sponsor’s audience area, he or she must complete all necessary paperwork required by Sponsor via FAX or email.

 

Award recipient is required to provide his/her valid Social Security Number to Sponsor and any affiliated prizing partners for tax purposes.  Award recipient must also complete an IRS W-9 form in order to receive award.  Failure to provide Sponsor a valid Social Security Number or to complete an IRS W-9 form will result in disqualification.  Award recipient is solely responsible for all federal, state and local taxes on retail value of cruise, air transportation, and any other component of the award and, as applicable, will be issued an IRS Form 1099 based on the retail value determined by Sponsor.

 

For identification purposes, award recipient must show Sponsor a valid photo ID, or provide a copy thereof.

 

As a condition of receiving the award, recipient will be required to complete an affidavit of eligibility and a liability and publicity release (as permitted by law), which must be signed prior to boarding the cruise ship.  Persons traveling as the guest of an award recipient must also sign any release that Sponsor may require.

 

Failure to sign the affidavit or release or to present the required photo ID may, at the sole discretion of Sponsor, result in an award recipient’s disqualification and the forfeiture of his or her interest in the award.

 

10.       Disclaimers.

 

No refund or compensation will be paid in the event of the cancellation or delay of the cruise trip (“Trip”), or any portion thereof.  Sponsor will not be liable if the Trip, or any portion of it, is cancelled or delayed.  Sponsor may, in its sole discretion, attempt to reschedule for a future cruise.  Boarding passes are subject to certain terms and conditions as specified by issuer.  The terms and conditions of the boarding passes may govern if the Trip is cancelled due to weather, an act of God, an act of terrorism, civil disturbance or any other reason.  Sponsor is not responsible for, and will not replace, lost, mutilated, or stolen boarding passes.  Exact details, including stateroom locations, shall be determined in the sole discretion of Sponsor.  The award recipient and his/her guest are responsible for obtaining any insurance (including, but not limited to, any travel or health insurance) and identification documents necessary for travel.  Those without proper citizenship documentation will be denied boarding.

 

Sponsor is not responsible for accidental, deliberate, negligent, or reckless acts committed by award recipient or guest that may result in stateroom property damage while aboard the Celebrity Summit.  Award recipient must pay any incidental charges at check-out when returning to port in San Juan, Puerto Rico.  Sponsor also assumes no responsibility for award recipient and guest’s belongings.  Award recipient should report lost, stolen, or damaged personal property to Celebrity Cruises management.

 

Airline tickets are subject to certain terms and conditions as specified by issuer.  Sponsor is not responsible for, and will not replace, lost, mutilated, or stolen airline tickets, vouchers, or certificates.  Exact details, including seat locations and flight itinerary, shall be determined in the sole discretion of Sponsor.

 

Once air transportation has been booked for award recipient and guest, no changes can be made to the itinerary without risk of penalty.  Award recipient and guest are responsible for any costs associated with a flight change.

 

No refund or compensation will be paid to award recipient or guest in the event their outbound flight to San Juan, Puerto Rico or return flight to the airport nearest their permanent residence is cancelled, postponed, or delayed.  No refund or compensation will be paid to award recipient or guest in the event either party misses or cancels a flight due to illness, family emergency, traffic, or any other reason.  Sponsor will not be liable for flight cancellations or delays.  Sponsor will also not be liable for lost, late, stolen, or damaged baggage that is the property of award recipient and guest.  Any and all disputes or claims must be reported to the airline.

 

The award recipient and his/her guest must travel together on the identical itinerary.  All travel dates and arrangements are subject to change based on availability and provider’s approval.

 

The award recipient may be required to present a credit card at time of hotel check-in in San Juan, Puerto Rico.

 

Unless a child of the award recipient, guest must be at least eighteen (18) years of age as of the date of departure.

 

Components of award may not be sold, traded, transferred, refunded, commissioned, substituted or redeemed for cash value.

 

11.       Publicity.  Except where prohibited, participation in the Promotion constitutes each participant, nominee, and award recipient’s irrevocable consent to the publication of his or her name in on-air promotional announcements produced by Sponsor.

 

Each participant, nominee, and award recipient further grants Sponsor, Celebrity Cruises, Milne Travel, Cabot Creamery, and their respective affiliates, digital properties, and advertising, promotion and production agencies, permission to use his or her name, address or likeness in any and all advertising and promotional materials, in any manner or media whatsoever, including websites or social networking webpages operated by Sponsor, Celebrity Cruises, Milne Travel, or Cabot Creamery, for purposes of advertising, trade or promotion, without additional compensation.

 

Each participant, nominee, and award recipient acknowledges and agrees that he or she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, or distortion of his or her name or address.

 

12.       Participation.  Participation in the Promotion constitutes an agreement by each participant to comply with these Official Rules and the decisions of Sponsor and any judges or administrators selected by Sponsor, which are final and binding in all respects.  Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Promotion as solely determined by Sponsor.  In the event the Promotion is compromised by non-authorized human intervention, fraud, tampering, technical failures or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Promotion, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Promotion.  Should the Promotion be terminated prior to the stated expiration date, Sponsor reserves the right to select an award recipient based on the eligible nominations received before the termination date.  Proof of sending or submission of a nomination will not be deemed proof of receipt by Sponsor.

 

13.       Release.  BY PARTICIPATING IN THE PROMOTION, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS SPONSOR, COX MEDIA GROUP, LLC, COX ENTERPRISES, INC., CELEBRITY CRUISES, MILNE TRAVEL, CABOT CREAMERY, AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE PROMOTION OR CRUISE, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, ILLNESS OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE PROMOTION; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY AWARD; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE PROMOTION OR ANY AWARD.

 

14.       Limitations of Liability. By PARTICIPATING IN THE PROMOTION, PARTICIPANTs acknowledge and agree that EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE AWARD, IS provided “as is” and that Sponsor makes no representations or warranties OF ANY KIND, express or implied, about the AWARD and sponsor hereby DISCLAIMS all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose.  (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE RELEASED PARTIES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.)

 

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by PARTICIPANTs, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the PROMOTION; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the NOMINATION process or the PROMOTION; (4) technical or human error which may occur in the administration of the PROMOTION, the processing of NOMINATIONS, or the notification of any AWARD RECIPIENT; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A PARTICIPANT’S participation in the PROMOTION or receipt or use or misuse of any AWARD. 

 

Only the number of awards stated in these Official Rules is available to be accepted in the Promotion. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of awards as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to distribute the award based upon which entry received the highest score according to the judging criteria.

 

15.       Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Georgia.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
