2013 Southwest San Juan Getaway Contest

1. SPONSORS: Southwest San Juan Getaway Contest (“the Contest”) is sponsored by Cox Radio, Inc., d/b/a 95.5FM and AM750 News/Talk WSB and Southwest Airlines (collectively, "Sponsors")., whose decisions regarding winner selection and all other aspects of the Contest shall be final and binding in all respects.
2. CONTEST PERIOD: The Contest will begin Monday, August 19, 2013 and will conclude on Friday, September 6, 2013. Sponsor will be the official timekeeper for the Contest.
3. ELIGIBILITY: The Contest is only open to legal residents of the state of Georgia who are 21 years of age or older at time of entry. Contest void where prohibited by law. Employees of Sponsor, and each of its affiliated companies, and advertising and promotional agencies (and the immediate family members of all such employees, and all others with whom they are domiciled) are not eligible to participate in the Contest or win prizes. The term “immediate family members” includes spouses, grandparents, siblings, children, and grandchildren, regardless of where they live.
4. HOW TO ENTER: Enter the Contest by clicking on the Southwest San Juan Getaway Contest link at wsbradio.com, and completing all of the required information and following all posted instructions on the contest page at wsbradio. By participating in the Contest, you agree to be bound by Sponsor’s Visitor Agreement and Privacy Policy, which are hereby incorporated by reference and are posted on www.wsbradio.com. You may also enter the Contest by sending a 3x5 post card or piece of paper including your name, age, daytime phone number, mailing address, and email address to: “Southwest San Juan Getaway Contest”, c/o News/Talk WSB, 1601 West Peachtree Street, Atlanta, Ga. 30309. Only one (1) entry per outer stamped envelope. Deadline for receipt of all entries (including mail-in entries) is 3:00pm (ET) on Thursday, September 5, 2013 in order to be eligible for the final prize announcement on Friday, September 6, 2013.
BY ENTERING THE CONTEST, YOU ACKNOWLEDGE AND AGREE THAT NEWS/TALK WSB MAY ANNOUNCE YOUR FULL NAME LIVE ON-AIR IF YOU ARE RANDOMLY SELECTED AS A POTENTIAL WINNER AND YOU HEREBY CONSENT TO THE STATION DOING SO. YOU ALSO REPRESENT AND WARRANT THAT YOU ARE SUBMITTING YOUR CONTEST ENTRY ON YOUR BEHALF AND NOT ON BEHALF OF ANY OTHER INDIVIDUAL.
Maximum one (1) entry per person and per email address during the Contest, regardless of method of entry.
All entries must be complete in order to qualify for the Contest. The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void that participant’s entries and may result in participant’s disqualification. Incomplete, lost, late, postage-due, illegible, misdirected, automated, mechanically-reproduced, forged or mutilated entries will be disqualified. Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Sponsor’s Contest application service provider or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent, provided that such person satisfies all other Contest eligibility requirements. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Contest.
Listeners accessing Sponsor’s station audio via IP connections like website-based streaming or mobile devices are welcome to enter. However, Sponsor cannot be responsible for delays in electronic transmission of station audio to IP devices. By entering this Contest, listeners acknowledge their understanding and agreement to this specific provision of these Official Rules. In addition, Sponsor will not be responsible for loss of service to the Contest line or for a participant’s failure to reach the Contest line due to malfunction of any network or system, congestion, any technical or human error, failures or malfunctions of any kind, including the congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service to Sponsor during a name announcement for the Contest, or a change in programming that results in Sponsor’s inability to air a call-in opportunity, the call-in period for the name announcement affected by the interruption may or may not be replayed at the resumption of service, in Sponsor’s sole discretion.
5. PRIZES AND ODDS: Subject to verification of eligibility and compliance with these Official Rules.
Four (4) winners will win a pair (2) of roundtrip tickets anywhere Southwest Airlines flies. Prize is for tickets only and does not include hotel or airport transfers.
APR $500.
Grand Prize: One (1) winner will win four (4) roundtrip tickets on Southwest Airlines San Juan, Puerto Rico and a three (3) night stay in San Juan. Prize does not include airport transfers.

By accepting a prize, each winner acknowledges and agrees that the prices of products and services offered as prizes often fluctuate. Winners further agree that the value stated in these Official Rules for the prize or prizes offered reflects the good faith estimate of the Sponsor, which shall be final and binding for all purposes relating to the Contest, including the reporting of prize values to the Internal Revenue Service.
The odds of being selected as a potential winner of a prize announcement call-in opportunity will depend on the number of eligible entries received.
Limit: One (1) prize per person and per household.
Southwest Airlines tickets are subject Southwest Airlines terms and conditions; certain restrictions may apply. No blackout dates. Tickets valid on Southwest-operated, published, scheduled service only in the United States and Puerto Rico. Tickets are not valid on code-share or AirTran operated service or any international service. Airline tickets awarded will expire one year from date of issue. Expiration dates will not be extended, and tickets will not be refundable or redeemable for cash or credit at any time, nor will tickets be replaced if lost or stolen. Tickets may not be sold to a third party. If the winner does not live in a city served by Southwest Airlines, he/she is responsible for transportation to the nearest airport served by Southwest Airlines.
6. WINNER SELECTION, NOTIFICATION AND ACCEPTANCE: One (1) times each weekday beginning on Monday, September 2, 2013 through Friday, September 6, 2013, Sponsor will air a live announcement of the name of an entrant randomly selected from among all eligible entries received through the day prior to such announcement. A maximum of five (5) prize announcement call-in opportunity winners will be selected in the five (5) random drawings conducted during the Contest. All five (5) drawings will be done under the supervision of Sponsor. The names of potential winners will be selected at random at 3pm the weekday before they are announced. Each weekday the week of September 2nd one potential winner’s name will be announced on-air at the top of the hour, immediately preceding the news at approximately 6pm, , during The Eric Erickson Show on News/Talk WSB.
Any individual claiming to be the entrant whose name was announced during a call-in opportunity will need to verify his or her entry information, including the mailing address on his or her entry form, in order to claim his or her prize. In the event that multiple prize claims are made by individuals with the same names in response to a prize announcement, the prize will go to the individual whose mailing address matches the mailing address specified on the entry form randomly drawn as the potential winner for such announcement, subject to verification of eligibility and compliance with these Official Rules.
As a condition of receiving any prize, winners must complete all necessary paperwork required by Sponsor within fourteen (14) business days of prize notification (including, without limitation, an affidavit of eligibility and a liability and publicity release). Completed paperwork can be submitted via fax, email or in person. All winners may claim their prize at the offices of News/Talk WSB, 1601 W. Peachtree St., NE, Atlanta, Georgia 30309, during regular business hours Monday-Friday (between 9:00am (ET) and 5:00pm (ET)) within 15 business days of calling in for a prize announcement or elect to receive their prize via mail after submitting their completed paperwork. Each winner must provide Sponsor with a valid government-issued photo ID or a copy thereof. Failure to present the required government-issued photo ID may, in Sponsor’s sole discretion, result in forfeiture of the prize.
Each winner is solely responsible for the reporting and payment of any taxes on prizes. Each winner may waive his or her right to receive the prize. No substitutions allowed by winner. Prize and individual components of the prize package are subject to availability and Sponsor reserves the right to substitute prizes or components of prize packages with a prize or component of equal or greater value. Prizes are non-assignable and non-transferable. Winners may be required to provide their valid Social Security Number to Sponsor for tax purposes and/or complete an IRS W-9 form in order to claim a prize. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
Failure to complete all necessary paperwork, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner’s disqualification and the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Contest constitutes each winner’s consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from News/Talk WSB, and Cox Media Group, and on their respective digital properties, and to the inclusion of his or her name and image in any other related publications or Web sites for any commercial or promotional purpose, without limitation or additional compensation. Winners’ names may be obtained by sending a request with self-addressed, stamped envelope to News/Talk WSB 1601 W. Peachtree St., NE, Atlanta, GA 30309.
A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF PARTICIPANT’S ELIGIBILITY.
7. PARTICIPATION: Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules and the decisions of Sponsor and any Contest administrators selected by Sponsor, which are final and binding in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In addition, Sponsor reserves the right to suspend, cancel or modify the Contest if it determines, in its sole discretion, that fraud, tampering, technical failures or other causes beyond the control of Sponsor have compromised the administration, security, fairness or proper operation of the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on entries received before the termination date. Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsor.
8. LIMITATIONS OF LIABILITY: By PARTICIPATING IN THE CONTEST, PARTICIPANTS acknowledge and agree that EVERYTHING REGARDING THIS CONTEST, INCLUDING THE WEBSITE AND THE PRIZES, ARE provided “as is” and that Sponsor makes no representations or warranties OF ANY KIND, express or implied, about the PRIZES and sponsor hereby DISCLAIMS all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE RELEASED PARTIES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.)
The Released Parties (DEFINED BELOW) are not responsible for: (1) any incorrect or inaccurate information, whether caused by PARTICIPANTs, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the CONTEST; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the CONTEST; (4) technical or human error which may occur in the administration of the CONTEST, the processing of entries, or the notification of any winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A PARTICIPANT’S participation in the CONTEST or receipt or use or misuse of any prize.
Only the number of prizes stated in these Official Rules is available to be won in the Contest. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award the prizes by a random drawing among all legitimate eligible prize claims. In no event will Sponsor award a total number of prizes in excess of $90,000.
9. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Georgia. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
10. GENERAL RELEASE: BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS SPONSOR, COX MEDIA GROUP, LLC, COX ENTERPRISES, INC., AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE CONTEST, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE CONTEST; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY PRIZE; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE CONTEST OR ANY PRIZE.
11. PROMOTIONAL RELEASE: By submitting an entry, each contestant grants to Sponsor the right to use his or her submission in any manner or media all without further compensation. Each contestant further grants to Sponsor and its affiliates and advertising, promotion and production agencies, and their respective assigns, the absolute right and permission to use his or her name, address, photograph and/or likeness in any and all advertising and promotional materials, in any manner or media whatsoever, for purposes of advertising, trade or promotion. Each contestant acknowledges and agrees that he or she shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, or distortion of his or her name, submission, address, photograph or likeness.
12. MISCELLANEOUS: Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials or announcements relating to the Contest.
